These Terms and Conditions (“TAC”) may be altered at any time at the discretion of PorcelainSky.com (“PorcelainSky”). Such changes will be presented at log-on; however, each player is responsible for being aware of their obligations pursuant to the TAC at all times. Failure to comply with the TAC may result in the immediate deletion of the player’s account. These TAC apply to all accounts, including players with "donator" status.
GAME LAW
Pursuant to Game Law, players agree to follow all game rules and laws. The game rules and laws may be accessed by clicking “Rules” on the Help Files home page while logged-on. Failure to adhere to Game Law may result in the immediate deletion of the player’s account.
CONNECTIVITY
PorcelainSky does not guarantee connectivity.
AGE REQUIREMENTS
This game is not intended for persons under sixteen (16) years of age. Some content may be inappropriate for young children. By joining, you are stating that you are sixteen years of age or older, or have parental permission.
INTELLECTUAL RIGHTS
Any individual who attempts to reverse engineer, hack, gain unauthorized entry into, or undermine the system integrity of this site (including attempting to access internal parts of the game from an offsite location) will have their account(s) removed from gameplay and any future accounts permanently closed. Such incidents may be pursued to the fullest extent of the law.
USER GENERATED CONTENT
To the extent that portions of this site allow users to post and/or exchange information, ideas, and opinions (“postings”) in chat rooms, message boards, private mail, and coven descriptions, please note that postings do not necessarily reflect the views of PorcelainSky.
Although PorcelainSky may periodically monitor posted content, it assumes no responsibility or liability for any postings or for any claims, damages, or losses resulting from their appearance or use. Players are solely responsible for the content of their messages and postings.
PorcelainSky reserves the right to edit, delete, or refuse to post any content that violates these TAC and may revoke the privileges of any player who does not comply.
OPERATIONAL INTERFERENCES
Players agree not to interfere with site operation or content through software or other means. Any automated software written to interact with the game is strictly forbidden.
Players agree to follow all administrative requests and instructions. Interference with this site or failure to follow administrative instructions may result in immediate account deletion.
PAYMENTS
If a payment tied to an account is charged back or refunded and the player wishes to continue playing, a reinstatement fee of $50.00 USD per charge/revoke must be paid.
Once a charge is made to an account, that charge cannot be transferred to another account. Ensure all orders are placed to the proper account.
FORCE MAJEURE
PorcelainSky shall not be responsible for any failure to perform its obligations under this Agreement, including connectivity issues or loss of account information, if such failure is caused by events beyond its reasonable control.
JURISDICTION
Any dispute arising in connection with the validity, interpretation, implementation, or performance of the TAC shall fall under the exclusive jurisdiction of the Courts of Tennessee, United States. The TAC are governed exclusively by the laws of Tennessee, United States.
ADDENDUM
Other sections of the game may have additional rules (such as chat room rules). These rules supplement the TAC and do not replace them.
Violation of additional rules constitutes a violation of the TAC and will be handled accordingly. Players are responsible for familiarizing themselves with all rules before playing. Ignorance of the TAC or game rules is not an acceptable defense.
